1. Scope of Services
Black Tiger Creative (“Company”) will provide logo design services based on the Client’s creative brief. This includes initial design concepts and up to five rounds of revisions to refine the final logo.

2. Client Responsibilities
The Client agrees to provide a clear, detailed brief, all necessary materials, and timely feedback at each stage to ensure a smooth design process.

3. Communication and Collaboration
Black Tiger Creative is committed to maintaining open and timely communication throughout the design process. The Client agrees to respond to communication and feedback requests promptly to ensure efficient progress on the project. Regular updates will be provided as needed to keep the Client informed of developments. If there are any significant delays or changes, both parties agree to communicate in advance wherever possible.

4. Revisions
The Client is entitled to five rounds of revisions to refine the logo design. Additional revisions beyond these five will incur a fee per revision. As rates are subject to change, we advise confirming the applicable fee at the outset of your project.

5. Payment Terms
A non-refundable deposit of 25% of the total project fee is required before any design work begins. The remaining balance is due upon the Client’s approval of the final design and must be paid before the final files are delivered.

6. Ownership and Rights
Ownership of the final logo design, along with all associated rights, transfers to the Client upon full payment. Black Tiger Creative reserves the right to feature the final logo in its portfolio and marketing materials unless the Client requests otherwise in writing.

7. Cancellation and Refunds
The 25% deposit is strictly non-refundable under any circumstances. If the Client decides to cancel the project after work has commenced, this deposit will not be refunded. If Black Tiger Creative is, for any reason, unable to complete the project as outlined in the brief, the deposit remains non-refundable; however, any remaining balance will be waived. This waiver will only be granted if Black Tiger Creative has been afforded adequate time and opportunity to address and resolve any concerns raised, and it is at the sole discretion of the Company to determine whether this condition has been met.

8. Project Inactivity
If the Client fails to communicate with Black Tiger Creative regarding an ongoing project for a period of more than 90 days, the project will be considered inactive and will be closed. Any deposits paid will be treated as a final fee, covering the Company’s time and resources up to that point. No further edits, revisions, file transfers, or online storage of files will be provided beyond that date. Should the Client wish to resume the project after this period, it will be treated as a new project, requiring a new project submission, deposit, and adherence to the Company’s current pricing schedule, unless otherwise waived in writing by an authorised representative of Black Tiger Creative.

9. Scope Adjustments After Submission
If, after 30 days from the date of initial project submission and after preliminary designs have been provided, the Client requests significant changes to the original project scope—including but not limited to changes in the business name, theme, or core purpose—the project will be treated as a new engagement. Black Tiger Creative’s design work is specifically created for the original project as outlined, and no further designs will be produced for any altered name or theme under the initial agreement. Any such changes will require a new project submission and deposit payment in line with Black Tiger Creative’s current pricing. Previously paid deposits or balances will be finalised as fees for the original project, and new deposits and fees will apply to the revised project as requested by the Client.

10. Exclusivity to Agreed Project
All design work produced by Black Tiger Creative under this agreement is exclusively tied to the project as outlined in the Client’s initial brief. Any requests for additional or unrelated designs beyond the agreed scope will be considered a separate project, requiring a new order form and additional deposit as per Black Tiger Creative’s current pricing.

11. Limitation of Liability
Black Tiger Creative’s liability for any claim related to this project will not exceed the total amount paid by the Client for the logo design service. The Company is not liable for indirect damages or additional costs arising from the use of the logo.

12. Acceptance of Terms
By engaging Black Tiger Creative for logo design services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
